1. About these terms
1.1 These terms govern your access to and use of the website published at www.psyentific.co.uk (the 'Site') and any content, features or services made available through it (together, the 'Service').
1.2 The Site is operated by Kiryl Oliveira, a sole individual based in the United Kingdom ('we', 'us', 'our'). The Site is a personal publication and is not operated by, on behalf of, or in the name of any company, partnership, regulated firm or other legal entity.
1.3 By accessing the Site, registering for a free account, or subscribing to email updates, you agree to be bound by these terms. If you do not agree, you must not use the Service.
1.4 We may amend these terms at any time. The version published on this page is the version in force. Material changes will be notified to registered subscribers by email. Continued use of the Service after changes take effect constitutes acceptance.

2.1 The Service is intended for users aged 18 or over. By using the Service, you confirm that you are at least 18 years old.
2.2 The Service is directed at users in the United Kingdom. It is made available elsewhere on an 'as is' basis. We make no representation that the Service is appropriate or available for use in any other jurisdiction.
3. Accounts and subscriptions
3.1 Certain features of the Service, including receipt of posts by email, require you to register an account by providing a valid email address.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3.3 Free subscriptions are made available at our discretion and may be modified, suspended or terminated at any time without notice.
3.4 We may in the future introduce paid subscription tiers. If we do, separate paid-subscription terms will apply, including provisions on payment, renewal, cancellation and refunds, and you will be asked to accept them before any payment is taken. Nothing in these terms obliges us to offer paid tiers, or to offer them on any particular terms.
4. Acceptable use
4.1 You agree not to:
(a) use the Service in any way that breaches any applicable law or regulation;
(b) use the Service to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material;
(c) knowingly transmit any data, send or upload any material that contains viruses, trojans, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
(d) attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site;
(e) attack the Site via a denial-of-service attack or a distributed denial-of-service attack;
(f) use any automated system, including without limitation 'robots', 'spiders' or 'offline readers', to access the Service for any purpose without our express written permission;
(g) use the Service, the content published on it, or data derived from it, to train, fine-tune, evaluate, benchmark or otherwise develop any machine learning or artificial intelligence model, without our express written permission;
(h) scrape, harvest, frame, mirror or systematically extract content from the Site without our express written permission; or
(i) impersonate any person or entity, or misrepresent your affiliation with any person or entity.
4.2 We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, where we reasonably believe these terms have been breached.

5.1 All content published on the Site, including text, graphics, layout, design and selection and arrangement of materials (the 'Content'), is owned by or licensed to Kiryl Oliveira and is protected by United Kingdom and international copyright laws.
5.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access the Content for personal, non-commercial use, and to share short extracts for the purposes of comment, criticism, review or news reporting in accordance with the fair dealing provisions of the Copyright, Designs and Patents Act 1988, provided that the source is clearly attributed and the meaning is not distorted.
5.3 Except as expressly permitted under clause 5.2, you may not copy, reproduce, republish, transmit, distribute, sell, license, adapt, edit or create derivative works from the Content without our prior written consent.
5.4 'Psyentific' is a UK registered trademark owned by Kiryl Oliveira, registered under UK trade mark number UK00003902998. The Psyentific name, logo and associated brand elements may not be used without prior written consent, including but not limited to use in domain names, social media handles, product or service names, advertising, or in any manner that suggests endorsement or affiliation.
5.5 Any rights not expressly granted by these terms are reserved.
6. User-submitted content
6.1 Where the Service permits you to submit content, including comments, messages or feedback ('User Content'), you grant us a perpetual, worldwide, royalty-free, non-exclusive, transferable and sub-licensable licence to use, reproduce, edit, adapt, publish and display such User Content in connection with the Service.
6.2 You warrant that any User Content you submit is your own original work or that you have all necessary rights to grant the licence in clause 6.1, and that it does not infringe the rights of any third party or breach any applicable law.
6.3 We reserve the right to remove, edit or refuse to publish any User Content at our sole discretion, without notice.

7.1 The Site may contain links to third-party websites, services or resources. Such links are provided for convenience only. We do not control, endorse, or accept responsibility for any third-party content, websites or services, or for any loss or damage arising from your use of them.

9. Limitation of liability
9.1 Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded or limited.
9.2 Subject to clause 9.1, we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:
(a) loss of profits, sales, business, or revenue;
(b) loss of business opportunity, goodwill or anticipated savings;
(c) loss or corruption of data or information;
(d) indirect, consequential or special loss;
arising out of or in connection with your use of, or inability to use, the Service or reliance on any Content.
9.3 Subject to clause 9.1, our total aggregate liability to you arising out of or in connection with the Service, whether in contract, tort (including negligence) or otherwise, shall not exceed one hundred pounds sterling (£100).

11.2 You may terminate your account at any time by unsubscribing from the email list or by contacting us at the address in clause 14.

12.1 Your use of the Service is also governed by our Privacy Policy, published at www.psyentific.co.uk/privacy, which forms part of these terms.
13. General
13.1 If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.2 No failure or delay by us to exercise any right or remedy under these terms shall operate as a waiver of that right or remedy.
13.3 These terms constitute the entire agreement between you and us in relation to the Service and supersede any prior agreements or understandings.
13.4 You may not assign or transfer your rights under these terms. We may assign or transfer ours, including to any successor in title to the Service.
13.5 A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.
14. Governing law and jurisdiction
14.1 These terms, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales.
14.2 The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms.
